About Cross Border Store

‘Cross Border Store’, a brand of FSN International Private Limited, a company incorporated under the laws in India, is an international marketplace for beauty & cosmetic products providing Indian customers access to international brands not otherwise available in India with the prices being inclusive of applicable duties and taxes. Customers will need to provide Know Your Customer (KYC) documents for importing the products they wish to purchase as they will be the importer on record for custom purposes in India. Cross Border Store will only be available on the ‘Nykaa mobile app’, and customers will only be able to purchase Cross Border Store products from the ‘Nykaa mobile app’.

International Seller Terms and Conditions

The Cross Border Store Terms and Conditions ("Terms and Conditions") shall be applicable to you when you place an order through any of the sellers located outside India ("International Sellers") on Cross Border Store on Nykaa’s App. These terms and conditions will be applicable in addition to Nykaa’s standard Terms & Conditions ( https://www.nykaa.com/terms-conditions ). Should there be any conflict in Nykaa’s standard Terms & Conditions, the Cross Border Store Terms & Conditions shall have precedence.

Customs Clearance & Customer Authorization

When placing an order via Cross Border Store, you, the customer, understand and acknowledge that (1) you are placing your order with the International Seller, (2) the products are located outside India and the importation process will start only post order completion, (3) the products are for personal use and not for resale, and (4) the sale takes place in the jurisdiction where the International Seller is located, and therefore, you agree that such sale is subject to the laws and regulations of the country from which the International Seller is selling the product and the courts of such country will have the exclusive jurisdiction.

The customer, you, will be the importer on record for all Cross Border Store products and will need to provide KYC details to customs authorities based in India.You will also be providing authorization to the chosen courier/logistics company to act as your agent with the customs and tax authorities in India as per prevailing laws in India, to carry out the customs clearance of your merchandise and pay the customs duties and taxes levied by customs and tax authorities in India. You further agree the ordered product/s is for your personal use or that you will be gifting the product/s to another individual, and in any case that the product is being purchased for personal use only and not for resale or for any commercial use. You understand that it is strictly prohibited to resell any product/s ordered via Cross Border Store. The risk of loss and title for such products that you purchase from Cross Border Store passes to you upon the delivery of such product to the courier/logistics company chosen by the International Seller on Cross Border Store.

Import Fees & Deposit

Cross Border Store products may be subject to import tax and fees. As the importer on record, you are solely responsible for paying these taxes and fees. We will estimate the amount of import tax and fees for Cross Border Store products and provide you an all-inclusive price with a break-up of import tax and fees charged to you when you place an order.

You authorise Cross Border Store to designate a carrier/ courier/logistics company ("Designated Carrier") to act as your agent with the relevant customs and tax authorities, to carry out the customs clearance for the merchandise, process and pay the import tax and fees for such items.

To obtain details regarding the import fees, or to obtain documentation or receipts in connection with customs clearance, you may contact the Designated Carrier specified in your shipment confirmation e-mail. You agree to grant the authorizations on behalf of yourself or the receipt designated in case of gifts or other purchases made on behalf of another recipient in your order for Cross Border Store products.

You are required to provide Photo address proof for custom clearance and delivery of the Products as per the Know Your Customer (KYC) documents norms that are applicable to import of products into India.

You can submit Aadhar Card/Passport as ID/Address proof. Please note that the Name & Address on your ID/Address Proof needs to exactly match with Name Address details that you have used while placing the order. Should the delivery address be different than the address on the photo ID, you will have to provide address proof as well. You can use any of the below mentioned documents as your address proof:

  • Bank account statement
  • Electricity bill
  • Employee ID
  • Hotel booking receipt
  • LPG connection receipt
  • Rent agreement
  • Hostel ID/College ID with hostel fee receipt

Warranties for Products purchased from International Sellers

Customers must note that for the products purchased via Cross Border Store, warranties and other after-sale services if provided by manufacturers may not apply outside of the country from which the products are shipped.

Product Description and pricing

Cross Border Store attempts to be as accurate as possible in describing the products. However, Cross Border Store does not warrant that product descriptions are accurate, complete, reliable, current, or error-free. A small number of the items we offer may be mispriced. If the correct price of an item sold by International Seller is higher than our stated price given at the time of placing the order, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Shipping Policy – Cross Border Store

How does the delivery process work?

Once we receive your order it is passed on to the Seller on Cross Border Store marketplace to processes your order.

After the products on your order pass through the final round of quality check by the Seller, they are packed and handed over to a trusted delivery partner.

The delivery partner brings your products to India, clears customs and pays all the applicable customs duties & taxes on your behalf. In case, they are unable to reach your provided address or at a suitable time, they will contact you to resolve the issue.

What is the range of locations to which Cross Border Store ships their products?

Nykaa ships throughout India!

My order has been shipped. Now how can I track it?

Once your order has been dispatched, you will receive an email with the details of the tracking number and the courier company that is processing your order.

You can track the status of your package 24 hours after your order is dispatched from the Seller’s warehouse on the designated courier companies' website.

What is the estimated delivery time?

Your order will be dispatched within 3-5 business days. Orders will typically take 2-4 weeks for delivery, our courier partners cannot guarantee the time taken by customs authorities in India to clear your shipment. We thank you for your patience when it comes to the delivery of Cross Border Store products.

My order will be shipped in multiple shipments? What does this mean?

Don’t worry! This is a completely normal situation. This just means that different parts of your order may have simply been shipped from different Sellers and different warehouse locations.

Are there any shipping charges applicable on my order?

We have standard shipping charges for all Cross Border Store orders.

A flat charge of INR 500 is charged for each order.

Can I use the Cross Border Store on desktop?

At present Cross Border Store is only available on the ‘NYKAA MOBILE APP’.

Returns, Cancellations & Refunds

There shall be no cancellations and returns for products bought via the Cross Border Store after a product has been shipped.

I am being asked for KYC by the courier and Nykaa CS teams; why?

You are required to provide Photo address proof for custom clearance and delivery of the Cross Border Store products as per the Know Your Customer (KYC) documents norms that are applicable to import of products into India.

Will I have to pay additional duties & taxes at the time of delivery?

  • The price you paid on the Cross Border Store is an all-inclusive price and you will not pay any additional amount at the time of delivery.

Liability

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, THE FSN INTERNATIONAL PRIVATE LIMITED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. FSN INTERNATIONAL PRIVATE LIMITED WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

Privacy

Your privacy is important to us, and we know that you care about how information about your order is used and shared. We would like our customers shipping products internationally to be aware that cross-border shipments are subject to opening and inspection by customs and/or postal authorities.

Also, we may provide certain order, shipment, and product information, such as titles, to our international carriers, and such information may be communicated by the carriers to customs and/or postal authorities in order to facilitate customs clearance and comply with local laws.

If the order is a gift, the package is marked "Gift," but the cost of the item is still stated on the customs form. Customs authorities require the value of the gift item to be stated directly on the package.

ANNEXURE - 1

POWER OF ATTORNEY AND AUTHORIZATION LETTER

I/ We, the Importer on Record ("IoR"), having interest in the merchandise that are in the package as described in the invoice, hereby grant this Power of Attorney ("PoA") to the relevant International Seller ("International Seller") having sold the product to the IoR to designate the Designated Carrier (as defined below) to clear my/ our imported package(s) that I/ we have purchased through the Nykaa mobile application. This PoA further authorizes the Designated Carrier to provide services for transportation, brokerage and customs clearance processes in India on my/ our behalf. Further, as the IoR, I/ we hereby authorize the Designated Carrier to provide this document to Indian Customs and CBEC agents and authorities as per the Annexure to the Customs Circular No.9/2010 (www.cbec.gov.in/htdocs-cbec/customs/cs-circulars/cs-circulars-2010/circ09-2k10-cus ).

I/ we further confirm, that I/ we provide this PoA to the International Seller and the Designated Carrier by agreeing to the terms and conditions of the International Seller while placing the order and completing the payment.

I/ we hereby authorize the carrier and/ or broker designated by the International Seller (together with its affiliates and its and their respective customs clearance and other agents, collectively, the "Designated Carrier"), to:

(a) act as my/ our agents and to do all acts necessary on my/our behalf including to file all documents, declarations and Bills of Entry for customs/ octroi clearance of all import shipments at landed cost that are consigned to or by me/ us through the courier through express or formal customs clearance mode;

and

(b) file all documents on my behalf that may be necessary for import customs clearance of shipments based on the declaration and information regarding the goods provided to the Designated Carrier as a result of my/ our purchase on Nykaa’s mobile application.

This PoA shall remain valid and continue in full force and effect until revoked in writing and acknowledged by the Designated Carrier in writing and shall cover all my/ our shipments purchased from the International Seller and sent to my/ our address in India. This authorization may be produced and presented before any customs station in India as a formal authorization to the Designated Carrier for customs clearance of my/ our shipments by the Designated Carrier.
